Sally-Ann Provan Millinery

Definitions

In these terms and conditions,

  • "We/us/our/ours" means the seller, Sally-Ann Provan Millinery

  • "You/your/yours" means the buyer/purchaser

  • "Goods" means the goods which we shall supply to you in accordance with the Contract.

 

PLEASE READ THIS AGREEMENT CAREFULLY. IT SETS OUT THE TERMS UNDER WHICH SALLY-ANN PROVAN MILLINERY OFFERS YOU USE OF ITS HATS, HEADBANDS AND HEADPIECES (HEADWEAR).

BY HIRING HEADWEAR FROM SALLY-ANN PROVAN MILLINERY (the company) either through our website or in-person, YOU AGREE THAT YOU HAVE READ AND ACCEPT THE TERMS AND CONDITIONS AND PRIVACY POLICY.

 

This Agreement is made between you and Sally-Ann Provan Millinery whose registered office is 9 Gayfield Square, Edinburgh, Scotland, UK. EH1 3NT

The following terms and conditions apply:

TERMS AND CONDITIONS (CONDITIONS OF HIRE)

The headwear remain the property of Sally-Ann Provan Millinery at all times.

 

All hire headwear shall only be posted to UK addresses.

​

The full Hire Fee of the headwear and a security deposit of around 60% of the Hire Fee is payable on reservation. The security deposit shall be refunded on the safe return of the headwear hired.

​

Hire period is 7 days.

​

Once a piece of headwear has been taken for hire it is considered a hire even if not worn and there will be no refund.

 

Sally-Ann Provan Millinery will not be liable for any delay or failure to deliver due to circumstances which are out of its control; or for any damage or injury caused by the misuse of the Company’s property.

​

The liabilities of the hirer commence at the time the hired headwear is collected or shipped from our premises, and continue until they are returned to the premises or Sally-Ann Provan Millinery.

 

HOW TO HIRE A HAT

Browse the selection available, click on an item to be taken to the product listing page.

Choose a duration of hire, and date of 'Day 1' and put the item in the basket.

Follow the link in the product listing (or the link in the Hat Hire drop-down menu in the main menu at the top of each page) to add the security deposit to the basket.

Checkout and pay.

 

You can also make a hire appointment at our Edinburgh city centre studio to choose and collect the hat you wish to hire. You can also return it here, by arrangement.

HOW TO RETURN A HAT

Package the hat safely using the original packaging.

There is a return address label in the box, but you the hirer, are responsible for the return shipping costs.

The hat must be shipped back to us using a tracked and insured service on the final day of the hire, this will be 'Day 7'. If the final day lands on a Sunday or Bank Holiday - then the hat must be shipped back the following day.

BILLING AND OF PAYMENT

By signing up for the Service, you authorize Sally-Ann Provan Millinery to bill you with Hire Fees, Deposit, Shipping Fees, Overdue Fees (if applicable) and all applicable taxes, and any other charges you may incur in connection with your use of the Service. Credit and debit cards are accepted as payment, all card payments are handled by either PayPal or Stripe and must be made in full at the time of placing the order.

The applicable fees will be paid to Sally-Ann Provan Millinery on the date your hire is made.

SECURITY DEPOSIT AND LATE RETURN FEES

A security deposit of around 60% of the Hire Fee (or £50 whichever is the higher) is payable on reservation. The security deposit shall be refunded on the safe return of the headwear hired, after it has been checked.

​

If your headwear is not returned on the due return date agreed when the purchase was made, Sally-Ann Provan Millinery will charge you an ‘Overdue Fee’ of £40 per day in addition to your Hire Fee and Shipping Fees.

​

CANCELLATION POLICY

The full hire fee will be refunded for cancellations made more than14 days before the hire date.

There will be no refund issued for cancellations made less than 14 days prior to the hire date.

​

HAT CARE AND RESPONSIBILITY

Please care for the hired headwear carefully, especially when worn in the rain, keep it under an umbrella when it is raining, and be aware of certain fabrics and trimmings can susceptible to weather damage in bad conditions (especially silk and silk flowers).

 

Sally-Ann Provan Millinery reserves the right to retain the full security deposit if the headwear is returned marked or damaged in any way. This includes but is not limited to loss of trimmings, damage to trimmings, holes, dents, dirt, stains and rain marks.

If a piece of headwear is lost, stolen, or damaged/dirty beyond repair (as decided on sole distraction of Sally-Ann Provan Millinery), there will be a replacement charge up to the full retail value of the piece charged to the hirer – full retail value is detailed in each product listing.

​

Under no circumstances should you attempt to clean a piece of headwear, please inform Sally-Ann Provan Millinery of any dirt or marks before returning the headwear to us.

 

Should a previous hirer not return a piece of headwear you have booked to hire or it is damaged, Sally-Ann Provan Millinery will endeavour to find a suitable replacement.

Liability is limited to the return of the hire charge if a suitable alternative is not available.

SECURITY & PRIVACY

Your order payment is processed remotely by either PayPal or Stripe. We do not store any of your financial information in our system.

CURRENCY & PRICES

All prices shown are in GBP (£ sterling) and include all taxes applicable within the U.K. Whilst every effort is made to ensure prices are correct, occasional errors or other technical problems may result in inaccurate prices being shown. In such cases we are not required to honour incorrect prices. Prices are subject to alteration without notice; however once we have accepted and confirmed an order, the price for that item(s) will not change.

 

DUTIES & TAXES

All hire headwear shall only be posted to UK addresses for wear within the UK.

​

SHIPPING

Outbound UK shipping is free (The hirer is responsible for all return shipping costs).

We always supply the name of the shipper and tracking information, so that you the customer can track your order online. Shipping companies do not always leave a card when they attempt a delivery, so it is important that you the customer check the tracking for your parcel online so that you can make alternative arrangements with the shipping company if needed.

If a customer is not available when delivery is attempted, and does not make alternative arrangements with the shipping company, and does not collect their parcel from the Delivery Office/Sorting office within the allotted time, and the parcel is returned to us, then the customer will be charged for the return shipping to us.

​

If returning hats by post/courier all headwear must be posted using a tracked service, wrapped securely, and insured to the value of the headwear. The hirer is responsible for all return shipping costs.

​

All Sally-Ann Provan hat boxes must be returned with the headwear, please wrap the box in the original bubble wrap or cardboard packing carton and do not tape directly to the hat box or mark it in any way.

​

DAMAGE IN TRANSIT

While we do our best to pack the Goods securely, we cannot accept any liability for any damage or deterioration in the Goods which occurs, for any reason, while the Goods are in transit to you.

All UK orders will be sent by Royal Mail Next Day Guaranteed Delivery or UPS, which includes proof of postage and receipt of delivery, transit insurance and Track & Trace (where you can trace your parcel online at www.royalmail.com) free of charge. â€‹

COLOURS & DESCRIPTIONS

Every care has been taken to ensure that all colour representations are portrayed as accurately as possible and that all product descriptions are correct. If you require additional photographs of an item - please ask, if we have additional images on file - we will gladly oblige.

​

Due to differences in monitor and browser settings every computer screen will display colour differently; we cannot guarantee that the colour of the item will be an exact match as seen on your screen.

*Please also note that all hats are carefully made individually to order by hand.

 

INTELLECTUAL PROPERTY

We take our copyright and intellectual property rights very seriously.

By using this website, you acknowledge and agree that all content (including but not limited to all images, text, graphics and actual products) are protected by copyright, and design rights as applicable, which are owned by Sally-Ann Provan Millinery.

You agree that you will not (nor assist or facilitate any third party to) commercially exploit or create derivative works from the products and other content on this site.

 

RETENTION OF TITLE

Under all normal circumstances, goods will be paid for prior to despatch. Neither the ownership of, nor the title in any goods sold by us, will pass from us until such time as we have received cleared payment in full for such goods and any additional charges relating to such goods. Until such time, we reserve the right to recover possession of the relevant goods.

 

GENERAL

These terms and conditions are subject to alteration by us without notice.
